General Terms and Conditions of Miles & More GmbH for Lufthansa WorldShop

1. Our quality

Each product we offer has passed our exacting quality inspections. The statutory defect liability provisions apply. If, despite expectations, defects are found, you may be entitled to a manufacturer’s warranty with a period of validity exceeding that of the statutory warranty period. If reference is made to a manufacturer’s warranty in the description of an article, your statutory defect liability rights against us remain unaffected thereby. Accordingly, please do not discard your invoice or delivery receipt and, if applicable, the manufacturer’s warranty card. We are happy to provide you with the content of the warranty and all other information necessary to submit your warranty claim. 2. Establishment of contract

Our presentation of goods represents merely a non-binding offer to you to order goods from us. Once your order is received by Lufthansa WorldShop, you will receive an order confirmation. If you have provided an e-mail address, it will be sent in the form of an e-mail. This represents only a confirmation of receipt, and not a legally binding acceptance of your order. Sales contracts between you and Miles & More GmbH are formed by the acceptance of your order – by means of delivery of the goods ordered – by Miles & More GmbH. The minimum order value for all orders is € 15.
The goods remain the property of Miles & More GmbH until payment is received in full.
Our prices of course include statutory German VAT (as of August 2015; changes to VAT reserved). For deliveries outside Germany, sales tax may differ; the delivery address shall be determinative. The final price may differ accordingly. The publication of a new catalog voids all prices from preceding catalogs.
In the event of a discrepancy between the graphical representation of a product and the information provided in the corresponding article description, the information from the article description shall be controlling. All data concerning performance, dimensions, weights, and sizes is sample data measured for each article. If the graphical image for an article contains additional decorative material, such decorative material is not covered by the sales contract or included in the scope of delivery, unless otherwise specified by the product description.
The contract is generally concluded in German language or other languages if available.

We store the text of this contract and send you the order information via e-mail, provided that you have given us your e-mail address. You may see your order information in your customer profile at www.worldshop.eu. You may read our General Terms and Conditions on our online shop page at /page/terms.

3. Our delivery period, capability, and delivery costs

Our delivery period is up to 7 days after receipt of your order, unless otherwise specified in a particular case. The delivery period for articles marked as requiring freight forwarding may be up to 6 weeks after receipt of your order, unless otherwise specified in a particular case. If an approximate delivery period is given for an item, this reflects the maximum delivery period. Deliveries are carried out on working days, from Monday through Friday. Items ordered with express delivery (only available within Germany) before 12 noon (on working days from Monday through Friday) will be delivered on the next working day (Mon.-Fri.). Items for which express delivery is not available are specially marked.
Orders to addresses within Germany will be shipped by the carrier DHL Paket GmbH. International orders will be shipped through DPD Dynamic Parcel Distribution GmbH & Co. KG. In Switzerland, deliveries are carried out by Swiss-Post Schweizerische Post AG (CH). In certain cases, delivery may be made using a freight forwarder. In that event, delivery and the delivery date will be coordinated by telephone between the recipient of the delivery and the freight forwarder.
For deliveries within Germany, a delivery and handling fee of € 5.95 will be charged. For deliveries to AT, BE, DK, ES, FI, FR, GR, IE, IT, LU, NL, PT, SE and UK, the delivery and handling fee will be € 9.50. For deliveries to Switzerland or Liechtenstein, a flat fee of € 25 will be charged, including customs duties and fees. Customs duties and fees for deliveries to the Canary Islands will be borne by the recipient. For deliveries to BG, CY, CZ, EE, HR, HU, LT, LV, MT, PL, RO, SI and SK, a flat fee of € 29 will be charged.
If express delivery service is selected, an additional fee of € 13 will be charged. This amount will not be reimbursed if the goods are returned in accordance with Sections 4 or 5 of these General Terms and Conditions.
If gate delivery service is selected and is available for the product, a service fee of € 19.95 will be charged in lieu of delivery. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer; for deliveries via freight forwarder, delivery shall be to the curbside. The place of performance for Gate Delivery is the airport you have selected, either in Frankfurt am Main or in Munich.

4. Voluntary return policy of WorldShop

Without prejudice to your statutory right of withdrawal, you may return goods purchased from us through our online shop, in Lufthansa wireless Inflight Entertainment or via mail order at any time within four weeks of receipt of such items by the person specified at the delivery address (for recurring deliveries of comparable items, within four weeks of receipt of the first partial delivery). No reason for the return need be given. To return an item, send it back to us using the return shipping sticker and the return receipt provided, as long as the goods are complete, unused, and undamaged. This requirement does not preclude a normal handling to establish the nature, characteristics, and functioning of the goods. nature, characteristics and functioning „Handling to establish the nature, characteristics and functioning“ is understood as the testing and trying out of a good, in the manner possible and normal for in-store purchases.

Timely return delivery of the goods or of the notice of return shall be sufficient to meet the requirements of the return period given above.

Return delivery will be made using the service provider printed on the return label: DHL International GmbH. For items not capable of being sent via parcel post we will arrange for the articles to be picked up by a freight forwarder.
This right of return does not apply for: a) articles produced on a custom basis, or containing customer specifications tailored to your requirements; b) articles bearing a special hygiene sticker or a hygienic seal, or which are packed with special hygiene-related markings, if the sticker or seal or special packaging has been removed; c) newspapers, magazines, and illustrated papers (unless order by telephone), as well as audio or video recordings (e.g. CD,s, videocassettes, DVDs) and software with opened packaging. This right of return is also excluded for services to be provided at fixed times in the areas of accommodations and transportation, as well as for perishable goods or goods whose sell-by date has been passed.
The same voluntary return conditions apply to articles ordered using gate delivery service as apply to returns from mail order deliveries. Returns made from outside the areas to which we provided delivery are made at the buyer’s expense.
Your statutory rights regarding defects and, if applicable, your manufacturer’s warranty rights remain unaffected.
Effect of the customer’s invocation of WorldShop’s voluntary return and refund policy:
If you return a good we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to return a good. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effect of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. 6. Your options for making payment in Euros

Within Germany, you may pay by means of the following: credit card or against invoice. Invoices are to be paid without deductions within the payment period specified on the invoice. Please specify your preferred payment method on the order form. Please note that payment by credit card is the only option available for deliveries outside Germany or for orders made in the Lufthansa wireless Inflight Entertainment.

7. Miles & More awards

For Miles & More, in particular for the redemption of award miles and the ordering of award bonuses (air travel, upgrade, travel, experience, and goods awards), the Miles & More participation rules apply, in addition to these General Terms and Conditions. The redemption of award miles for commercial or self-employed purposes is expressly excluded. Customers are therefore not entitled to receive an invoice. The minimum redemption amount for any Miles & More award is 3,000 miles.  For goods awards shipped to Germany, an additional 1,200 miles will be deducted as a flat shipping fee; for items shipped to AT, BE, CH, DK, ES, FI, FR, GR, IE, IT, LI, LU, NL, PT, SE and UK, the additional amount deducted will be 2,000 miles. We will charge an additional 6,000 miles for customs duties and fees for packages shipped to Switzerland or Liechtenstein. Shipment to BG, CY, CZ, EE, HR, HU, LT, LV, MT, PL, RO, SI, and SK will incur an additional charge of 8,000 miles.
4,000 miles will be added to the amount deducted for the shipping fee; this charge will not be reversed in the event that the goods are returned in accordance with Section 4 or 5 of these General Terms and Conditions. Upon request, we will also invoice shipping charges in Euros, as provided for in Sections 3 and 6.

8. Combined mileage redemption and supplementary payment in Euros

If a product is listed with both a mileage and a Euro price, it may be purchased through the redemption of miles and through supplementary payment in Euros. You can also combine the redemption of miles and the supplementary payment in Euro. Redemption of miles with supplementary payment in Euros is additionally subject to the following conditions: the minimum redemption amount for any order is 3,000 miles, and shipping costs must be paid in Euros, as provided for in Sections 3 and 6. After concluding the purchase, redeemed miles will be deducted automatically from your Miles & More Account. Please understand that we will request your credit card details alongside your Miles & More service card number in Lufthansa wireless Inflight Entertainment when you aim to redeem miles. In case of an insufficient amount of miles, we will only deduce the available miles from your Miles & More account and recalculate the ratio of miles redemption and supplementary payment in Euro for your order in Lufthansa wireless Inflight Entertainment after concluding the purchase. We will charge your credit card with the remaining amount for payment. For this, we require your confirmation during the order process in Lufthansa wireless Inflight Entertainment. If you have purchased products for Euro, it is not possible to redeem miles for the purchase afterwards. Same applies in the reverse case.

9. Miles & Travel, Miles & Event and ProTrain seminars

Travel and event offers and ProTrain seminars are provided by travel and event agents independent of Miles & More GmbH, to which we forward your booking requests. Bookings are dependent on availability, and are also subject to the General Terms and Conditions of the provider. 10. Traveling with luggage

The Lufthansa maximum carry-on luggage dimensions stated in the article description are based on the specifications of September 2010, and may differ from the standards applied by other airlines. We suggest that you consult with the relevant airline before undertaking your flight. Examine your luggage after every flight, immediately after removing it from the baggage carousel. In the event that damage is found, submit a complaint, both orally and in writing, to the airline or freight forwarder responsible, if possible prior to passing customs. Information about luggage insurance is available from any travel agent.
If you choose to make use of our gate delivery option, you are responsible for complying with the carry-on luggage regulations of the airline in question and the customs regulations of the destination country.

11. Data protection

Miles & More GmbH (MMG) stores, processes, and transmits the personal data it collects from its clients for the purpose of fulfilling its own business purposes especially for fulfilling contracts concluded by customers with MMG. Your data is collected upon receipt of your online order, paper order, or during a conversation with a member of our Customer Service staff. With your order, you declare your consent to the collection, processing, and transmission of your data in accordance with this data security declaration. In order to complete your order, MMG shares your information with external companies (e.g. freight forwarders). Furthermore, address and ordering information for Miles & More GmbH’s own advertising and marketing purposes is only stored and used with your permission. You may revoke your consent to the use, processing, or transmission of your information for advertising and marketing purposes at any time. 12. Applicable law and place of jurisdiction

For commercial transactions, these General Terms and Conditions are governed by the provisions of German law; applicability of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. For commercial transactions, Frankfurt am Main shall be the sole place of jurisdiction.
