General Terms and Conditions (T&Cs) of Miles & More GmbH applying to orders placed with Worldshop

Your order and its processing are subject to the following General Terms and Conditions.

1. Conclusion of contract

1.1 You are concluding a contract with Miles & More GmbH, Airport Frankfurt Lufthansa Base Gate 21, Airportring Building 322, 60546 Frankfurt/Main.

1.2 Please note that the presentation of our products represents merely a non-binding offering of items that you might wish to purchase from us. By clicking the “Buy now” button, you enter into a binding agreement to purchase the items in your shopping basket. An order confirmation will be emailed to you when you have submitted your order. This confirmation represents merely acknowledgement of the receipt of your order and does not constitute a legally binding acceptance of your order. The actual sales contract between Miles & More GmbH and you comes into effect when we accept your order - at the latest on delivery of the items in question. The minimum order value is 25 or 3000 Miles.

1.3 Our offers are targeted solely at consumers in the sense of Section 13 of the German Civil Code (Bundesgesetzbuch, BGB). The conclusion of purchase contracts with traders within the meaning of Section 14 of the German Civil Code is excluded. We reserve the right to refuse orders if there are indications that the buyer is a trader or that the goods are intended for commercial resale.

1.4 The stated prices include the applicable statutory VAT. For information on additional shipping and delivery costs, please see the shipping and delivery cost table at www.worldshop.eu/page/delivery. Items remain the property of Miles & More GmbH until paid in full.

1.5 If the items are not available through no fault of our own, we have no obligation to supply if we ourselves have not been supplied punctually or at all despite undertaking normal and appropriate transactions to ensure our sources of supply, and have informed you of this in a timely manner. In such cases, we will immediately refund any deducted miles and credit them to your account; any payments made by you will be refunded immediately.

1.6 All contracts are essentially concluded in the German language. Contracts may also be concluded in the following languages: English, Italian, French.

1.7 We will save your order details and send them to you by email. You can also view your order details in your customer profile at www.worldshop.eu

1.8 You agree herewith to receive invoices in electronic form (by email).

2. Delivery and shipping costs

You can view the delivery times for every country we ship to, the carriers we use and the costs of delivery and shipping in the section “Delivery” at www.worldshop.eu You can also find information about our “Airport Delivery” service on the same website. Delivery times may vary for specific items (due to their fragile nature) and, in particular, for items that are included in special offers. In this case, you can find the relevant information on our product and/or promotions page.

Deliveries to hotel addresses are excluded. Orders with a delivery address that corresponds to that of a hotel or similar temporary accommodation will not be fulfilled. If such an address is nevertheless provided, we reserve the right to cancel the order or request an alternative delivery address.color: Color value is invalid We shall not be liable for any delays or costs incurred as a result.

3. Payments

Orders for delivery within Germany can be paid for by credit card, per invoice or by advance payment. We accept payment by credit card or by advance payment only for orders for delivery outside Germany. However, transactions via PayPal, Apple Pay and Google Pay are currently only possible for delivery within and outside Germany for payment in Euros. Payments via Google Pay™ or Apple Pay® require the customer to have a valid credit card on file with the relevant payment service. The payment will be charged to this credit card. We reserve the right to not make certain payment methods available for your order and to ask you to use a different payment method. Invoices must be paid in full within 14 days of receipt of invoice. If you default on payment, we reserve the right to charge a flat rate of EUR 5.00/CHF 5.50 for each payment reminder sent to you to cover our losses caused by the delay in payment. You retain the right to demonstrate that no losses have been incurred or are in fact less than this sum. Payments by credit card will be charged to your credit card when the order is shipped. For payment in advance, we will send you our bank details by email and deliver the items once we receive payment. If we do not receive payment within 10 days of request of payment, we will cancel your order. The “Pay after flight” option is available for ordering on board during a flight using the plane’s internet connection. Please note that “Pay after flight” is not actually a method of payment. It simply allows you to initiate your purchase; you will pay using the payment methods available once you have landed.

4. Redeeming Miles & More miles

4.1 4.1 You can also redeem your miles for awards available through our Worldshop. A minimum of 3,000 miles per order is required when redeeming miles for awards. The minimum number of miles to be used may be higher for certain products. This will be indicated on the relevant product page.

4.2 You can view flat rate shipping charges under “Delivery” at www.worldshop.eu/page/delivery.

4.3 The redeemed miles will be automatically deducted from your Miles & More account on conclusion of the order process.

4.4 Award miles may not be redeemed by individuals for purposes associated with their business or self-employment. Customers are not automatically entitled to receive an invoice.

5. Redeeming miles and part payment in in euros / Swiss francs

You can also combine the redemption of award miles with a part payment in euros or Swiss francs for your order. In this case, you will need to redeem at least 3,000 miles for each order. The minimum number of miles to be used may be higher for certain products. This will be indicated on the relevant product page. Shipping costs must be paid in euros or Swiss francs.

an explicit declaration of your decision to cancel this contract (e.g. in a letter sent by post or by email). You may use the model cancellation form provided below, although you are not obligated to do so.

You must dispatch the declaration of your intent to exercise your right of cancellation within the 14-day cooling-off period to ensure compliance with the terms of cancellation.

Consequences of cancellation

If you cancel this contract, we are obligated to refund without delay all payments received from you including delivery costs (with the exception of additional costs incurred because you selected a delivery method other than the most cost-effective standard delivery method we offered you) or at the latest within 14 days of receipt of your notice of cancellation. Unless expressly agreed otherwise with you, refunds will be made employing the same payment method you used to pay for the original transaction; under no circumstances will you be charged in connection with a refund. We can refuse to reimburse you until we have either received the returned items or you have provided evidence to us that you have returned these, whichever of these occurs at the earlier point in time.

You must return the items prior to expiry of the 14-day cooling-off period to ensure compliance with the terms of cancellation.

We will bear the cost of returning the items.

However, you will be required to make up for the loss of any value of the items in question if this is attributable to actions on your part that were not required to verify the condition, properties and functionality of the items.

8. Diritto di reso volontario

Indipendentemente dal Suo diritto legale di recesso, Le concediamo volontariamente un diritto di reso entro quattro settimane dal ricevimento della merce. Nell’ambito di promozioni speciali ci riserviamo di escludere tale diritto di reso concesso volontariamente. In tal caso tutte le informazioni al riguardo saranno specificate sulla pagina dell’articolo e/o della promozione in questione. Lei può usufruirne restituendoci la merce entro quattro settimane dal suo ricevimento, senza indicare alcuna motivazione. In caso di più forniture di merce dello stesso tipo, il termine decorre dal ricevimento della prima fornitura parziale.

Generalmente le restituzioni sono gestite dalla società di servizi indicata sull'etichetta di reso. In caso di merce che non può essere spedita tramite pacco postale, incarichiamo uno spedizioniere di effettuarne il ritiro.

Questo diritto di reso non è contemplato per: a) articoli personalizzati o realizzati su specifiche del cliente in base alle sue esigenze; b) articoli provvisti di uno speciale adesivo igienico, di un sigillo igienico o di un imballaggio speciale specificatamente contrassegnato per ragioni igieniche, se l’adesivo, il sigillo o l’imballaggio speciale sono stati rimossi; c) quotidiani, riviste e giornali illustrati; d) CD, DVD e software, se la confezione è stata aperta; e) articoli particolari per i quali l’esclusione di tale diritto è indicata sulla relativa pagina e/o sulla pagina della promozione speciale in questione; f) buoni. Questo diritto di reso è altresì escluso nel caso di servizi da effettuarsi in momenti stabiliti, in particolare relativamente a soggiorni o trasporti e nel caso di merce deperibile o la cui data di scadenza sia già stata superata.

Le spese per i resi provenienti da località non comprese nelle nostre zone di consegna sono a carico dell'acquirente.

Conseguenze dell’utilizzo del diritto di reso volontario con Worldshop:
Tutti i pagamenti già effettuati per gli articoli resi, incluse le spese di consegna e spedizione (ad eccezione dei costi supplementari derivanti dalla Sua scelta di un tipo di consegna diverso dalla più conveniente consegna standard da noi offerta), verranno da noi rimborsati immediatamente o, al più tardi, entro 14 giorni dal ricevimento della merce. In caso di merce che non può essere spedita tramite pacco postale e di resi provenienti dall'estero, fa fede il giorno di ricevimento della richiesta di ritiro. Per tale rimborso utilizzeremo lo stesso mezzo di pagamento da Lei impiegato per la transazione originaria, salvo laddove espressamente concordato altrimenti; in nessun caso Le saranno addebitati i costi del rimborso.

9. Responsabilità legale per i vizi della cosa e garanzie

9.1 Si applica la responsabilità legale per i vizi della cosa.

9.2 Nell’inconsueta circostanza che si manifestino vizi, oltre alla responsabilità legale per i vizi della cosa ha eventualmente diritto a beneficiare di una garanzia del produttore. Se nella descrizione dell’articolo è menzionata una garanzia del produttore, i Suoi diritti legali nei nostri confronti in caso di vizi della cosa restano impregiudicati. Quanto coperto dalla garanzia e le relative condizioni sono specificati all’interno del documento di garanzia.

11. Diritto applicabile e foro competente

In caso di vendita commerciale bilaterale si applica la legislazione tedesca, con l'esclusione della Convenzione delle Nazioni Unite sui contratti di compravendita internazionale di merci.

12. Procedura di risoluzione delle controversie

Non siamo obbligati a partecipare alla procedura di risoluzione delle controversie e non offriamo questo strumento.
